Publish AI-made novels, music, and film. Disclose the AI you used. Clear the 85% commercial-quality bar to go live. Purchases are processed by Apple, which takes its App Store commission; of the net proceeds you keep 85% and AI Marketplace retains 15%.

1. Acceptance

By creating an account or using AI Marketplace you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use AI Marketplace. To publish work or receive payouts you must be of legal age to form a binding contract in your jurisdiction and must comply with all laws that apply to your work.

3. Your account

You are responsible for your account credentials and for activity on your account. Provide accurate information; keep it up to date. We may suspend accounts that show signs of fraud, abuse, or violation of these terms.

4. Creator content and intellectual property

You retain ownership of the work you publish. By publishing on AI Marketplace you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, distribute, and promote your work within the app, on this website, and in our marketing — solely for operating the marketplace. You confirm that you hold all rights to the work, its cover art, and the prompts and tooling behind it, and that publication does not infringe anyone else's intellectual property, privacy, or publicity rights.

5. Mandatory AI disclosure

Every title must accurately declare which AI systems were used to produce or assist it. Undisclosed, misattributed, or fraudulent AI claims are grounds for removal and account suspension. Disclosures are public.

6. Quality review (AI Editor)

Submissions are evaluated by our AI Editor against a published rubric. A minimum score of 85 out of 100 is required to be accepted. The score is advisory and may evolve as the rubric improves. Scoring is not a guarantee of commercial success or legal compliance — that is the creator's responsibility.

7. Originality — no copycats

Every title must be original. The AI Editor compares submissions against the existing catalogue and rejects work that is too similar to a published title. Cloning another creator's work, or any third-party work, is grounds for rejection and removal.

8. AI Autopilot

If you enable AI Autopilot, you authorise the AI Editor to publish a submission on your behalf when it clears the 85% bar with sufficient confidence. You remain the publisher of record and are responsible for everything Autopilot posts on your behalf. You can disable Autopilot at any time in the app.

9. Pricing, fees, and royalties

You set your list price within the allowed range. Apple processes every purchase and applies its standard App Store commission first. Of the remaining net proceeds, you keep 85% and AI Marketplace retains a 15% service fee. We may change fees and pricing bands on notice.

10. Creator payouts

Payouts to creators are processed by Stripe (Stripe Connect Express). To receive payouts you must complete Stripe's onboarding and accept Stripe's Connected Account Agreement. You are solely responsible for taxes on your earnings. Where required, we and Stripe will collect tax information (for example a W-9 or W-8) and may issue tax forms such as Form 1099. We may withhold or delay payouts where required by law or to investigate suspected fraud.

Payout timing. Creator payouts can take up to a month to fund. Apple settles in-app purchases on a monthly cycle, so a sale you made today may not reach your bank until the next Apple settlement plus Stripe's standard processing time. Once funds reach your Stripe Connect balance they're paid to your bank on Stripe's default schedule (typically a few business days after settlement).

11. Purchases and content access

Buying a title grants you a personal, non-transferable, revocable licence to access it within the app for your own private enjoyment. You may not redistribute, resell, broadcast, sub-licence, or use purchased content to train machine-learning systems.

12. Refunds

All purchases are processed by Apple. Refunds for in-app purchases are handled by Apple under Apple's policies; please request refunds through Apple at reportaproblem.apple.com.

13. Acceptable use

You may not publish, upload, or transmit content that is illegal, infringing, sexually exploitative of minors, harassing, hateful, defamatory, deceptive, or that contains malware. You may not attempt to break, probe, or interfere with the service, evade the review process, or use the service to launder funds.

14. Reporting and moderation

Users can report any title or creator from inside the app. We review reports and may remove content, suspend creators, or both. We aim to act on serious reports within 24 hours. There is no tolerance for objectionable content as defined in App Store Review Guideline 1.2.

15. DMCA / copyright takedowns

If you believe content on AI Marketplace infringes your copyright, send a notice to mvalasek77@gmail.com including: identification of the work, the infringing material, your contact details, a good-faith statement, a statement under penalty of perjury that you are authorised to act, and your physical or electronic signature. We will respond as required by the DMCA and may terminate repeat infringers.

16. Termination

You may stop using AI Marketplace at any time and delete your account in-app or by email. We may suspend or terminate accounts that violate these terms or that we reasonably suspect of fraud or abuse. Provisions that by their nature should survive termination will survive.

17. Disclaimers

Titles are provided by independent creators. AI Marketplace is the storefront and review service, not the author. The service and all content are provided "as is" without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we do not warrant that AI outputs are free of third-party rights claims — verifying training-data provenance and output non-infringement is the creator's responsibility, and the mandatory AI disclosure does not transfer that responsibility to us.

18. Limitation of liability

To the maximum extent permitted by law, AI Marketplace and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or USD 100, whichever is greater.

19. Indemnification

If you are a creator, you agree to defend and indemnify AI Marketplace from any third-party claim arising out of work you publish, including claims that the work infringes intellectual-property, privacy, or publicity rights, or that the AI disclosures you provided were incomplete or inaccurate.

20. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and excluding the UN Convention on Contracts for the International Sale of Goods. Nothing in these terms affects consumer-protection rights you have by law in your country of residence.

21. Disputes

You and AI Marketplace will first try in good faith to resolve any dispute informally. If a dispute cannot be resolved within 30 days, it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in English. You may instead bring a qualifying claim in small-claims court. You and we each waive any right to a jury trial and to participate in class actions, to the extent permitted by law.

22. Changes to these terms

We may update these terms; if changes are material we will notify you in-app or by email before they take effect. Your continued use after the effective date means you accept the updated terms.

23. Severability and miscellaneous

If any provision of these terms is held to be unenforceable, the remaining provisions remain in full force. No failure or delay by us in exercising a right operates as a waiver. You may not assign or transfer these terms or any of your rights under them without our prior written consent; we may assign these terms in connection with a merger, acquisition, or sale of assets. These terms (together with the Privacy Policy and any other document we expressly incorporate) are the entire agreement between you and us about the service and supersede any prior agreement on that subject.
